A regular meeting of the Village of Lakewood Planning Board was held Wednesday, October 16, 2019, 7:00 PM, in the Board Room of the Anthony C. Caprino Municipal Building, 20 West Summit Street, with Chairman Martin Idzik presiding. Board members present were Richard Rose, and Jeffrey Slater. Also present were Village Clerk/Secretary Joseph M. Johnson, Deputy Village Clerk Mary B. Currie and Building Inspector Jeff Swanson. Absent were Board members John Jablonski, III and John Shedd.
APPROVAL OF MINUTES
Motion by Richard Rose, seconded by Jeffrey Slater, to approve the minutes of the last regular meeting of the Planning Board held August 21, 2019.

PRELIMINARY SUBDIVISION PLAT REVIEW
310 EAST FAIRMOUNT AVE.
Washington Prime Group, 111 Monument Circle, Suite #3500, Indianapolis, Indiana, has submitted a request for Preliminary Subdivision Plat review/approval in accordance with Chapter 26 [Subdivision of Land], of the Code of the Village of Lakewood. Chautauqua Mall, LLC, is desirous of subdividing a .80 acre parcel, which abuts NYS Route 394, from its other commercially zoned parcels.
For the record Chairman Idzik asked for those in attendance to identify themselves. They included Ms. Julie Bihler, General Manager of the Chautauqua Mall, Mr. Corey Miller, Operations Supervisor for the Chautauqua Mall, Mr. Jeff Gossett, Licensed Land Surveyor for Greenman-Pedersen, Inc., Jamestown, N.Y., who was responsible for producing the survey of the subdivision plat and Mr. Ryan Vander Bosche, also representing the Chautauqua Mall.
Chairman Idzik asked if someone would like to briefly explain this proposed subdivision.
Mr. Jeff Gossett, LLS indicated earlier this summer representatives from the Chautauqua Mall and Washington Prime Group, approached Greenman-Pedersen. Inc., asking if they would be interested in preparing a survey, splicing-off a parcel of land, approximately 35,000 sq. ft. in size, from the rest of the property at the Chautauqua Mall. In short, Mr. Gossett said the survey for the proposed subdivision was done to create a separate tax parcel, which could be incorporated into a lease of the property. He said his survey work includes an overall map depicting the Chautauqua Mall property, plus a more detailed survey map of the property to be subdivided. Mr. Gossett said the detailed survey map is the same piece of property on which the new Taco Bell restaurant is being constructed. He noted the site plan for that project was previously approved by this Planning Board.
Chairman Idzik asked if title to the property in question expected to change hands.
Mr. Vander Bosche indicated that the Chautauqua Mall will remain the property owner. Mr. Vander Bosche said he has been working with the franchisee, noting it has been a general policy of the mall to subdivide what are referred to as “outparcels” in situations such as this. He said it is the intent of the Chautauqua Mall to retain the property at this time, but if for some reason things change, the property could easily be conveyed, for it will have already been subdivided.
Chairman Idzik asked Building Inspector Swanson, if he would like to comment on this preliminary subdivision plat review request.
Mr. Swanson said as was previously noted, the Taco Bello restaurant now under construction on the parcel of land in question, did receive site plan review approval. He said inquiries from the Washington Prime Group in Indianapolis actually triggered closer review of Chapter 26, [Subdivision of Land], of the Village Code, with respect to proposed subdivisions. To his knowledge this chapter of the code hadn’t been enforced in the past for similar subdivisions. In closing, Building Inspector Swanson, said he would like someone to explain the difference between a subdivision and a split.
Board member Jeff Slater wanted to be clear that the property to be subdivided would have its own separate tax bills, however it would remain, for the present time, under the ownership of the Chautauqua Mall, LLC.
Board member Richard Rose asked if there are other similar “outparcels” within the boundaries of the Chautauqua Mall.
Mr. Vander Bosche indicated the Olive Garden restaurant is located on a separate tax parcel however it is not owned by the Chautauqua Mall, LLC.
Motion by Jeff Slater, seconded by Richard Rose, for the Planning Board to approve the proposed Preliminary Subdivision Plat Review, wherein Washington Prime Group, Indianapolis, Indiana is permitted to create a .80 acre “outparcel” at the Chautauqua Mall, as a separate tax parcel abutting NYS Rt. 394, as depicted on the survey submitted by Greenman-Pedersen, Inc., Jamestown, N.Y. The newly subdivided property will be the site of a new Taco Bell restaurant, currently under construction.
