The eighteenth regular meeting of the Board of Trustees of the Village of Lakewood, N.Y., was held Monday, September 23, 2019, 6:30 PM, with Deputy Mayor Edward J. McCague presiding. Trustees present were Ellen E. Barnes, Randall G. Holcomb, and Douglas L. Schutte. Also present were Village Clerk Joseph M. Johnson, Village Treasurer Apryl L. Troutman, Police Chief John R. Bentley, Village Attorney John I. LaMancuso, Department of Public Works Supervisor Thomas R. Pilling, and Building Inspector Jeffrey A. Swanson. Absent was Fire Chief Steve Smouse.
APPROVAL OF MINUTES
Motion by Trustee Barnes, seconded by Trustee Schutte, to approve the minutes of the last regular meeting of the Board of Trustees, held September 9, 2019.

AUDIT OF CLAIMS
Motion by Trustee Holcomb, seconded by Trustee Schutte, that the claims as audited by the Auditing Committee of the abstract dated September 23, 2019, be approved and that the Clerk shall execute said abstracts (#17 & #17) and direct payment by the Treasurer. General Fund: $ 175,672.06, (Checks #16184 thru #16224), Trust & Agency Fund: $ 47,768.65 (Checks #4875 & #4876)

REPORTS
Deputy Mayor McCague reported that on September 19th he submitted a 2020 Comprehensive Grant Application to the Chautauqua Lake & Watershed Management Alliance, in connection with the Grandview Estates Stormwater Management Project. The grant, in the amount of $ 30,500.00, if awarded would fund Phase I and part of Phase II of this potential stormwater management project. Deputy Mayor McCague indicated it is a “full” grant, meaning there will be no matching funds required.
Deputy Mayor McCague also was pleased to report that he in is receipt of a check from William J. & Mary Rapaport, in the amount of $ 2,500.00, made payable to the Lakewood Community Development Corp. (LCDC), as a presenting sponsor for Lakewood’s first annual “Fall Fest”. This community event will be held Sunday, October 20th, from noon to 5:00 PM.
Department of Public Works Supervisor Thomas R. Pilling reported that the Erie Street stormwater culvert replacement project will begin tomorrow morning and that the Crescent Creek stormwater management project is moving along nicely. Mr. Pilling then asked if there is any word on the project to change-out the Village of Lakewood’s street lighting fixtures.
Trustee Holcomb said everything is on schedule to move forward with the project however we are awaiting some information from National Grid.
DPW Supervisor Pilling reminded everyone that employees must complete Sexual Harassment Training by October 9th.
Deputy Mayor McCague indicated that this training can be done on-line.
He then thanked Mr. Pilling for seeing to it that a few of the older trees at the north end of Chautauqua Ave. were cut down. Doing so should ensure the long term health of the other trees on the street.
Police Chief John R. Bentley reported the Lakewood-Busti Police Department has responded to six thousand six hundred eighty-three incidents year-to-date, three hundred sixty of which occurred during the past two weeks. He also reported that the surveillance cameras and audio systems throughout the Anthony C. Caprino Municipal Building have been upgraded, which were paid for with funds from the asset forfeiture account.
Chief Bentley then indicated that two L-BPD officers participated in a Child Safety Seat Program held at Jamestown/Lakewood Honda on September 10th. He also noted the office will be getting a new copy machine at a slight savings per month.
Chief Bentley also reported that L-BPD Officers became involved in another high speed chase that originated in the City of Jamestown, which went into Pennsylvania and came to a conclusion back in New York, on the Big Tree Road between Mead Road and Cowing Road. L-BPD Officer Goodwin was able to set-up spike strips, disabling the vehicle. The individual apprehended was involved with a recent gun heist in Corry, PA. In conclusion, Chief Bentley said he plans on having two Officers work the “Fall Fest” event on Sunday, October 20th.
Building Inspector Jeff Swanson reported bids for the demolition of the unsafe structures at 156 East Terrace Ave. and 22 East Summit St. have been submitted to the Chautauqua County Land Bank, so it shouldn’t be too long before work to raze them begins. He also noted that additional legislation on the state level has been adopted addressing abandoned or “zombie” properties. Mr. Swanson said with assistance from Village Treasurer Troutman, he wished to report that year-to-date $ 1,050.00 has been collected in fire inspection fees, $ 2,250.00 in zoning permit fees and $ 11, 602.00 in building permit fees for a total of $ 14,902.00.
COMMITTEE REPORTS
Trustee Schutte, representing the Lakewood Community Development Corp. (LCDC), indicated he would like to present Village Treasurer Troutman a check in the amount of $ 4,482.17. He said the check from the LCDC represents the amount of money received as donations towards this past year’s 4th of July Summerfest, less the cost of producing and mailing the flier for the annual fundraiser.
RESOLUTION #152-2019 – APPROVE NEW LFD MEMBER
Motion by Trustee Barnes, seconded by Trustee Schutte, for the Board of Trustees, acting as the Board of Fire Commissioners, to approve Mr. Mason Fisher, 12 Shirley Lane, Jamestown, N.Y., as a new member of the Lakewood Volunteer Fire Department, and to grant him “out of district” status.

RESOLUTION #153-2019 – APPROVE ROAD CLOSING FOR 1ST ANNUAL LAKEWOOD “FALL FEST”
Motion by Trustee Barnes, seconded by Trustee Schutte, to approve the closing of Chautauqua Ave., between Summit Street and Third Street as the venue for the first annual “Fall Fest”, to be held from noon to 5:00 PM, Sunday, October 20th. NOTE: Organizers will be closing down the street as early as 10:00 AM for set-up and keeping it closed until 6:00 PM, allowing for clean-up.

RESOLUTION #154-2019 – APPROVE SPECIAL MUSIC PERMIT APPLICATION
Motion by Trustee Schutte, seconded by Trustee Barnes, for the Board of Trustees to approve a Special Music Permit application, as submitted by Ms. Michelle Turner and Ms. Mary Rapaport, of Group Ther-Happy, 103 Chautauqua Ave., in connection with the first annual Lakewood “Fall Fest”.

RESOLUTION #155-2019 – AGREE TO SUSPEND LOCAL “OPEN CONTAINER LAW”
Motion by Trustee Schutte, seconded by Trustee Barnes, for the Board of Trustees to suspend the Village of Lakewood’s local “open container law” as stipulated in Section #15-6 of Article II, Chapter 15 of the Code of the Village of Lakewood, within the cordoned-off area on Chautauqua Ave. between the hours of noon and 6:00 PM, Sunday, October 20th, in connection with Lakewood’s first annual “Fall Fest”, and to authorize Deputy Mayor McCague to sign a New York State Liquor Authority Special Event Permit Application. NOTE: Strict measures will be in place controlling the sale and dispensing of alcoholic beverages during the event.

ESOLUTION #156-2019 – POSTPONE NEXT REGULAR BOARD OF TRUSTEES MEETING
Motion by Trustee Barnes, seconded by Trustee Holcomb, that due to the upcoming Columbus Day holiday, Monday, October 14th, to postpone the next regular meeting of the Board of Trustees, previously scheduled for 6:30 PM, Monday, October 14th, until 6:30 PM, Tuesday, October 15th. The meeting will be held in the Anthony C. Caprino Municipal Building, 20 West Summit Street, Lakewood, N.Y., preceded by a 6:00 PM, work session.

RESOLUTION #157-2019 – AUTHORIZE PAYMENT OF UNBUDGETED EXPENSE
Motion by Trustee Barnes, seconded by Trustee Holcomb, authorizing Village Treasurer Troutman, to remit payment in the amount of $ 1,050.00, to Stohl Environmental, Orchard Park, N.Y., for services rendered in connection with the New York Main Street Grant (Chautauqua Ave.). This expense, which is fully reimbursable through the grant, is to be paid from Account A8020.40, [Planning].
