A Special meeting of the Board of Trustees of the Village of Lakewood, N.Y., was held Tuesday, September 1, 2020, 9:00 AM, with Mayor Randall G. Holcomb presiding. Trustees present were Ellen E. Barnes and R. Richard Fischer. Also present were Village Clerk Mary B. Currie, Village Treasurer Apryl L. Troutman, Village Attorney John I. LaMancuso and Police Chief John R. Bentley. Trustees Edward J. McCague and Douglas L. Schutte participated through Zoom.us. Absent were Department of Public Works Supervisor Thomas R. Pilling, Fire Chief Kurt Hallberg and Building Inspector Jeffrey A. Swanson.
Mayor Randall Holcomb explained the reason for the special meeting this morning was to accept the outdoor music application as submitted by Group Ther-Happy.
Mayor Holcomb indicated the permit application is requesting Acoustic Music under the awning on Sundays from 4pm to 7pm through October 2020 and amplified music set up outside under a tent on Sunday, September 6th (Labor Day weekend).
Mr. Thomas Marlinski, 36 Ohio Ave., said the problem he has with music at Group Ther-Happy is the music never stops when it is scheduled to and he doesn’t understand why it has to be so loud when people are sitting right there.
Trustee Barnes indicated the permit is requesting the music within the time frame of what is permitted by village code and if the music gets to loud then the police should be called.
Ms. Michelle Turner, co-owner of Group Ther-Happy explained the reasons why the establishment is hopeful to have music and the type of music they plan to have. Ms. Turner also indicated they will try to have the music end closer to the time scheduled.
RESOLUTION # 134-2020 – ACCEPT OUTDOOR MUSIC PERMIT APPLICATION
Motion by Trustee McCague, seconded by Trustee Barnes, for the Board of Trustees to accept the Outdoor Music Permit Application as submitted by Group Ther-Happy, 103 Chautauqua Ave.
Adopted: 4 ayes, no nays (Barnes, Fischer, McCague, Schutte)
Motion by Trustee Barnes, seconded by Trustee Fischer, to recess the special meeting of the Board of Trustees at 9:18 AM, so as to enter into executive session to discuss Police Contract Negotiations.
Present at the executive session were Mayor Randall G. Holcomb, Trustee Ellen E. Barnes, Trustee Edward J. McCague. Trustee Douglas L. Schutte, Trustee R. Richard Fischer, Village Clerk Mary B. Currie, Village Treasurer Apryl L. Troutman, Village Attorney John I. LaMancuso and Police Chief John R. Bentley.
EXECUTIVE SESSION (Adjournment)
Motion by Trustee Schutte, seconded by Trustee McCague and unanimously carried to adjourn the executive session and special Board of Trustees meeting at 10:05 AM.
