A regular meeting of the Zoning Board of Appeals of the Village of Lakewood, NY, was held March 11, 2021 at 6:00 PM, in the Board Room of the Anthony C. Caprino Municipal Building, 20 W. Summit Street, with Chairman Gary M. Segrue, presiding. Board members who were present were Louis S. Drago, Jr., William F. Chandler, and Jerry Holmes. Also present were Deputy Village Clerk Jackie Hyser and Building Inspector Jeffrey A. Swanson. Absent was Phyllis Sorensen.
APPROVAL OF MINUTES
Motion by William F. Chandler., seconded by Jerry Holmes, to approve the minutes of the last meeting of the Zoning Board of Appeals on January 14, 2021.
Adopted: 4 Ayes, no nays (Segrue, Drago, Chandler, Holmes)
SIDE YARD SET-BACK VARIANCE
180 EAST TERRACE AVE.
Mr. Michael Clark and Ms. Amy Clark, 9446 Stone Mill Dr., Mentor, OH 44060, owner of 180 East Terrace Ave., have submitted an application for a side yard set-back variance regarding a proposal to install a 4ft. high fence on the west side of the single family residence at the above address. In accordance with the proposed site plan and related information they are requesting a side yard set-back variance of 0 ft., rather than the requires 2 ft., as prescribed in Section #25-10 (E) [Single Family Residential (R-1) District], of the Village of Lakewood Zoning Law.
Chairman Gary M. Segrue asked Mrs. Clark if she would briefly explain the reason for the variances she is requesting.
Mrs. Clark said they have three (3) golden retrievers and would like to install a fence off the back porch and connect it into their neighbors existing fence. Mrs. Clark said she spoke with neighbor Connie Lemon, who was also present, and she had agreed that it was ok for the Clark’s to tie into her section of the fence. Mrs. Clark also said they are installing the same type of fence as neighbor Connie Lemon, so everything looks the same. Mrs. Clark went onto say if there ever becomes any issue they would be willing to place their fence back from the property line.
ZBA member Louis S. Drago asked Mrs. Clark if the existing fence is on their property line.
Mrs. Clark responded with that she was not sure.
Building Inspector Jeffrey A. Swanson asked Mrs. Clark if they have a property survey done.
Mrs. Clark said that they have not and indicated the survey they have is from 25 years ago.
ZBA member Mr. Holmes asked if the fence will all be enclosed when done.
Mrs. Clark said yes it will be with the neighbor’s portions running along the westerly property line.
Ms. Connie Lemon said she is in favor of the Clarks request to adjoin to her fence. Ms. Lemon said the Clark’s have 3 dogs who are well behaved and well cared for. She is aware that there isn’t enough room for the dogs to run where they live, so Ms. Lemon understands why Mr. and Mrs. Clark would like to put in a fence for their dogs.
Motion by Louis S Drago, Jr., seconded by Mr. William F. Chandler, to approve and erect the fence on the western boundary of 180 East Terrace Ave. up to and not to exceed the existing property line and a best effort must be made to establish where the surveyed property line actually exists. If we discover that the property line does not meet your needs that you are to bring back to us as soon as you discover that we can rework your request.
Adopted: 4 ayes, no nays. (Chandler, Segrue, Drago, Holmes.)
Motion by Gary M. Segrue, seconded by Louis S. Drago, to adjourn the regular meeting of the Zoning Board of Appeals at 6:36 pm.
