The nineteenth regular meeting of the Board of Trustees of the Village of Lakewood, N.Y., was held, Tuesday, October 11, 2022, 6:30 PM, with Mayor Randall G. Holcomb presiding. Trustees present were Ellen E. Barnes, R. Richard Fischer, Nancy W. Jones and Benjamin J. Troche. Also present were Village Clerk Mary B. Currie, Village Treasurer Apryl L. Troutman, Police Chief Christopher A. DePonceau and Village Attorney John I. LaMancuso. Absent were DPW Supervisor Thomas R. Pilling, Fire Chief Kurt Hallberg and Building Inspector Jeff Swanson. A work session was held with no action taken.
APPROVAL OF MINUTES
Motion by Trustee Troche, seconded by Trustee Jones, to approve the minutes of the last regular meeting of the Board of Trustees held September 26, 2022.

AUDIT OF CLAIMS
Motion by Trustee Barnes, seconded by Trustee Fischer, that the claims as audited by the Auditing Committee of the abstracts dated October 11, 2022, be approved and that the Clerk shall execute said abstracts and direct payment by the Treasurer. Abstracts (#20 & #20) Trust & Agency Fund: $ 61,432.97, General Fund: $ 72,981.47, (checks #19183 thru #19231). Voided check #19217, ACH to M&T Bank.

REPORTS
DPW Supervisor Thomas R. Pilling previously submitted a written report stating that the apparatus from the playground at Richard O. Hartley Park has been dismantled and removed, making the site ready for the contractor to begin installing equipment for the new playground.
Police Chief Christopher A. DePonceau reported the Lakewood-Busti Police Department has had four hundred forty-seven incidents from September 26, 2022 to October 11, 2022 which included ninety-nine business checks, eight checked well beings, three domestic disputes, nine harassment complaints, nine vehicle accidents, twelve property checks, ninety-four vehicle stops, eleven shoplifting incidents, twenty-eight warrants were either entered or processed and said the speed trailer has been moved to six different locations.
Fire Chief Kurt Hallberg previously submitted a written report stating that as of 3:00 pm today, the Lakewood Fire Department has responded to eight hundred eighty-four alarms year to date which includes one hundred nineteen in the month of September. Chief Hallberg said so far this year the LFD has had one hundred twenty-three more calls than at this time in 2021.
Trustee Fischer congratulated Village Attorney John I. LaMancuso on being designated as a Rising Star in the Super Lawyers’ Annual List of Top Attorneys in Upstate New York for the fourth year in a row and thanked him for all he does for the Village of Lakewood.
Mayor Holcomb congratulated Building Inspector Jeff Swanson on his recent marriage and wish him and his bride Molly much happiness.
Mayor Holcomb thanked Trustee Barnes for stepping in as Deputy Mayor and running the September 26, 2022 Board of Trustees meeting, while he was out of town.
RESOLUTION #172-2022 – APPROVE SALE OF PROPERTY ON HOAG ROAD
Motion by Trustee Fischer, seconded by Trustee Barnes, for the Board of Trustees to approve the sale of two lots totaling approximately 2.83 acres of property on Hoag Road to Mr. Andy Ohl, Jamestown, NY, that is jointly owned by the Town of Busti and the Village of Lakewood. Per the bid submitted to the Town of Busti on September 30, 2022, Mr. Ohl will purchase 50 ft. x 2,462 ft. of right-a-way along the southern boundary of the property known as SBL 401.00-1-46 & 47 in the Town of Harmony for the sum of three thousand ten dollars ($3,010.00) and will incur all legal transfer, title search and necessary survey fees required to process the deed transfer.

RESOLUTION #173-2022 – ACCEPT RFP FOR HARTLEY PARK PLAYGROUND PROJECT
Motion by Trustee Fischer, seconded by Trustee Barnes, for the Village of Lakewood to accept the proposal, contingent upon a fully executed contract, as submitted by Titan Development, Inc., 8534 Seaman Rd., Gasport, NY in connection with the Village’s Local Waterfront Revitalization Project (LWRP) at Richard O. Hartley Park. Per the proposal, Titan Development will provide site preparation and the installation of all equipment for the new playground at the cost of $ 289,112.00.

RESOLUTION #174-2022 – AUTHORIZE ATTENDANCE TO SOUTHERN TIER WEST’S FALL TRAINING
Motion by Trustee Fischer, seconded by Trustee Barnes, to authorize Trustee Nancy W. Jones, Deputy Clerk/Treasurer Julie C. Toennis and Zoning Board of Appeals/Planning Board member, William F. Chandler to attend Southern Tier West’s Annual Fall Training at the Jamestown Community College Campus, Jamestown, NY, on November 17, 2022.

RESOLUTION #175-2022 – APPROVE COLLECTION OF UNPAID TAXES
Motion by Trustee Barnes, seconded by Trustee Troche, to authorize Village Treasurer Apryl L. Troutman to forward any and all unpaid 2022-2023 Village Tax Bills to the Chautauqua County Division of Taxation for collection. The dollar amount of unpaid taxes total $ 52,839.61.

RESOLUTION #176-2022 – AUTHORIZE FUND TRANSFER
Motion by Trustee Troche, seconded by Trustee Barnes, to authorize Village Treasurer Apryl L. Troutman to make the following fund transfer to reimburse three (3) Farmers Market vendors for three weeks of vendor fees; $ 90.00 from T1093.15 {Farmers Market Fund} to A8020.40 {Planning – Contractual}.

RESOLUTION #177-2022 – AUTHORIZE BUDGET TRANSFER
Motion by Trustee Fischer, seconded by Trustee Troche, to authorize Village Treasurer Apryl L. Troutman to make the following budget transfer for the NYCOM Annual Conference Training expenses for Deputy Mayor Barnes; $ 965.38 from A1990.40 {Contingent Account} to A1010.40 {Board of Trustees – Contractual}.

RESOLUTION #178-2022 – AUTHORIZE MID-YEAR BUDGET MODIFICATION
Motion by Trustee Jones, seconded by Trustee Barnes, to authorize Village Treasurer Apryl L. Troutman to make the following budget modification for the Grandview Stormwater Management Project grant; Add $ 313,760.00 to the budget for revenue account A103997.10 {Natural Resource – Stormwater Grants} and add $ 313,760.00 to the budget for expenditure account A8745.41 {Natural Resource – Stormwater}.
